Privacy Policy

This Privacy Policy applies to www.viAct.ai (the “Websites“) and the services, owned and operated by Customindz Inc. (“we“, “us“, “viAct.ai“). This privacy policy outlines our practices with respect to collecting, using and disclosing information through the use of our Websites and our services (“Services”).

What is viAct.ai?

viAct.ai is an AI-enabled computer vision platform that allows users to automate construction monitoring. Users can install cameras to provide images/videos from their site and the platform turns those into analytics and insights.

How do we collect information?

We collect two types of data and information: (i) Information that identifies an individual or may with reasonable effort identify an individual (“Personal Information“); (ii) un-identified and non-identifiable information pertaining to a user(s) (“Non-Personal Information). viAct.ai is not aware of the identity of the individual from which the Non-personal Information was collected.

viAct.ai may collect Personal Information online when an individual wants to become our business partner, when requesting a demo, when uploading a video/image for a trial, or when contacting us. The Personal Information we collect may include, without limitation, your first and last name, title, company name, email address and telephone number.

In addition, we may also collect Personal Information from our Website users’ devices. Such information includes IP address, a unique identifier which we generate, or other information which relates to the individual’s activity through the Services.

We may also collect and process content which you voluntarily submit and upload through your use of the Services (e.g. when you publish in our blogs).

Non-Personal Information which is being collected may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information (e.g. the type of browser and operating system your device uses, language preference, access time and the domain name of the websites from which you linked to the Services, Internet service provider (ISP), referring/exit pages, date/time stamp, and clickstream data). As is true of most websites, we gather this kind of information automatically and store it in log files. We use this information, which does not identify individual users, to analyze trends, to administer the Websites, to track users’ movements around the Websites, and to gather demographic information about our user base as a whole. We do not link this automatically collected data to personal information.

Cookies and tracking technologies

With regard to our Website users, we may from time to time use cookies – small records stored on your computer’s hard drive showing us the website pages visited. You can configure your web browser to disable our ability to set cookies. You can still visit our websites but your access to secure areas of our websites will require activation of per-session cookies.

We may also use a single-pixel transparent GIF image called a web beacon in HTML emails we send. If you click an email with a web beacon we can identify your response. You can prevent this by disabling HTML email on your computer.

The use of cookies by our tracking and service providers is not covered by our privacy policy. We do not have access or control over these cookies. Our tracking and service providers use session ID and persistent cookies to provide pre-filled and progressively enhanced forms to connect website usage to submitted form information, to help monitor incoming search referrals and to track website usage.

Our third party partners employ clear GIFs (aka web beacons/web bugs), images and scripts that help them better manage content to our websites. We do tie the information gathered to our customers’ or users’ personal information via third party partners.

Third parties, with whom we partner to provide certain features on our websites or to display advertising based upon your Web browsing activity, use Flash cookies to collect and store information. Flash cookies are different from browser cookies because of the amount of, type of and way that data is stored. Cookie management tools provided by your browser will not remove Flash cookies. Blogs and social media features

Our Websites offer accessible blogs. You should be aware that any information you provide in this area may be read, collected and used by others who access them.

You can request the removal of your personal information from our blog, by contacting us at info@viact.ai. In some cases, we may or may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why. Our Websites may also display personal testimonials of satisfied customers on our Websites in addition to other endorsements. With your consent we may post your testimonial along with your name. If you wish to update or delete your testimonial, you can contact us at info@viact.ai.

The Websites include social media features such as the Facebook and Twitter buttons, and Widgets such as the “Share This” button or interactive mini-programs that run on the Websites. These features may collect your IP address and which page you are visiting on the Websites, and may set a cookie to enable the feature to function properly. Social media features and Widgets are either hosted by a third party or hosted directly on the Websites. Your interactions with these features are governed by the privacy policy of the company which provided such features.

viAct.ai may also provide bulletin boards, blogs, or chat rooms on the Websites. Any personal information you choose to submit in such form may be read, collected, or used by others who visit these forums. viAct.ai is not responsible for the personal information you choose to submit in these forums.

How we use the information we collect

We may use and share Personal Information for the following purposes:

To provide our Services as described in this Privacy Policy;

To serve advertisements to Website Users;

To allow and manage social media features as part of our Services;

To send our Clients newsletters and marketing emails;

To manage the accounts of our Clients;

To send to our Clients relevant information and updates;

To generally understand the needs and interests of our Clients and Website users;

To conduct anonymous analytics in order to improve and customize our Services;

To support and troubleshoot our Services;

To investigate and resolve disputes in connection with our Services; and

To investigate violations and enforce our policies, and as required by law, regulation or other governmental authority, or to comply with a subpoena or similar legal process or respond to a government request.

In addition, viAct.ai may post a list of its clients and testimonials on the Websites that contain information such as clients’ names and titles. viAct.ai obtains the consent of each client prior to posting any information on such a list or posting testimonials.

With whom we share the information we collect

We do not rent, sell, or share your personal information with third parties except as described in this Privacy Policy.

We may share personal information with the following recipients: (i) our subsidiaries and affiliated companies; (ii) subcontractors and other third party service providers; (iii) auditors or advisers of our business processes; and (iv) any potential purchasers or investors in the company.

We will not share without your consent your Personal Information except as required by law, such as to comply with a subpoena, court orders and regulations or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud or respond to a government request. Research information is shared only in the aggregate and not for purposes of contacting you.

We reserve the right to share Personal Information consequent to a merger, acquisition or divestiture of our business. If viAct.ai is involved in a merger, acquisition or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our website of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information.

We may also provide your Personal Information to companies that provide services to help us with our business activities such as to fill your order or offer customer service. These companies are authorized to use your Personal Information only as necessary to provide these services to us.

viAct.ai uses a third-party service provider to manage credit card processing. This service provider is not permitted to store, retain, or use billing information except for the sole purpose of credit card processing on viAct.ai’s behalf.

Advertising

We partner with a third party ad network to either display advertising on the Websites or to manage our advertising on other websites. Our ad network partner uses cookies and web beacons to collect Non-Personal Information about your activities on this and other websites to provide you targeted advertising based upon your interests.

We do not use Google AdSense to publish ads on our websites, but we do use the Google AdSense service to show viAct.ai retargeting advertisements when you are browsing other websites. You may opt-out of the use of this cookie by visiting Google’s Advertising and Privacy page: http://www.google.com/policies/technologies/ads/.

How do we safeguard and transfer your information?

The security of your personal information is important to us. When you enter personal information on our service, we encrypt the transmission of that information using secure socket layer technology (SSL). We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. Therefore we cannot guarantee its absolute security. Users’ rights

viAct.ai values the individual’s privacy and control over his or her personal information and acknowledges their right to exercise certain rights relating to such information.

You may request to:

  1. Receive confirmation as to whether or not personal information concerning you is being processed, and access your stored personal information, together with supplementary information.

  2. Receive a copy of personal information you directly volunteer to us in a structured, commonly used and machine-readable format.

  3. Request rectification of your personal information that is in our control.

  4. Request erasure of your personal information.

  5. Object to the processing of personal information by us.

  6. Request to restrict processing of your personal information by us.

  7. Lodge a complaint with a supervisory authority.

However, please note that these rights are not absolute, and may be subject to our own legitimate interests and regulatory requirements.

Retention

We will retain the information you submitted to us for as long as your account is active or as needed to provide you Services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes and enforce our agreements.

Marketing

We may use your Personal Information, such as your name, email address, telephone number, etc. ourselves or by using our third party subcontractors for the purpose of providing you with promotional materials, concerning our services, which we believe may interest you.

Out of respect to your right to privacy we provide you within such marketing materials with means to decline receiving further marketing offers from us. If you unsubscribe we will remove your email address or telephone number from our marketing distribution lists.

Please note that even if you have unsubscribed from receiving marketing emails from us, we may send you other types of important e-mail communications without offering you the opportunity to opt out of receiving them. These may include customer service announcements or administrative notices.

A note to EU customers

viAct.ai complies with the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of Personal Information from the European Union member countries (including Iceland, Liechtenstein and Norway) and Switzerland to the United States, respectively. viAct.ai has certified to the Department of Commerce that it adheres to the Privacy Shield principles of Notice, Choice, Accountability for Onward Transfer, Security, Data Integrity and Purpose Limitation, Access and Recourse, Enforcement and Liability (the “Privacy Shield Principles“). If there is a conflict between the policies in this policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. viAct.ai is subject to the investigatory and enforcement powers of the Federal Trade Commission. viAct.ai is required to disclose Personal Information in response to lawful requests by public authorities, including to meet national security or law enforcement requirements, and is liable in cases of onward transfers to third parties, unless we prove that we are not responsible for the event giving rise to the damage.

In compliance with the EU-US and the Swiss-US Privacy Shield Principles, viAct.ai commits to resolve complaints about your privacy and our collection or use of your Personal Information. European Union or Swiss individuals with inquiries or complaints regarding our Privacy Shield policy should first contact us at info@viact.ai or by mail at the address below. Note that if we are processing your Personal Information under the direction of one of our clients, individuals with inquiries or complaints should contact the entity they originally placed their data with and who remains the data controller.

viAct.ai has further committed to refer unresolved Privacy Shield complaints to the Better Business Bureau (BBB) Privacy Shield, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgment of your complaint from us, or if we have not resolved your complaint, please contact or visit the BBB Privacy Shield at http://www.bbb.org/EU-privacy-shield/for-eu-consumers/ for more information or to file a complaint. The services of the BBB Privacy Shield are provided at no cost to you.

Please note that finally and under limited circumstances, EU or Swiss individuals with unresolved complaints can invoke binding arbitration before the Privacy Shield Panel.

Updates or amendments to the Privacy Policy

We may update this privacy policy to reflect changes to our information practices from time to time. If we make any material changes we will notify you by email (sent to the email address specified in your account) or by means of a notice on this website prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.
